Terms and Conditions of the Online Store – enchantedproducts.eu

I. General Provisions

1. These Terms and Conditions define the general conditions, the method of providing electronic services, and the sales conducted via the Online Store enchantedproducts.eu. The Store is operated by PBTO SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Cieszyn, ul. Stanisława Wyspiańskiego 13, 43-400 Cieszyn, KRS 0000646280, NIP 5482677576, REGON 365828259, BDO 000586594, share capital 20,000.00 PLN – hereinafter referred to as the "Seller".
2. Contact with the Seller takes place exclusively via:
   • e-mail address: hello@enchantedproducts.eu
   • the contact form available on the Store's website.
3. Sales are conducted exclusively within the territory of the Republic of Poland.
4. The Terms and Conditions are continuously available on the Store's website in a manner that allows for their acquisition, reproduction, and recording.
5. The Seller informs that the use of services provided electronically may involve risks characteristic of the Internet.

II. Definitions

1. Business days – days from Monday to Friday, excluding public holidays.
2. Customer – a natural person, a legal person, or an organizational unit placing an Order.
3. Consumer – a natural person performing a legal act not directly related to their business activity.
4. Goods – a product presented in the Store.
5. Sales Agreement – an agreement concluded between the Seller and the Customer.

VI. Delivery

1. Delivery is carried out exclusively within the territory of the Republic of Poland.
2. The Seller reserves the right to fulfill the order in installments in the event of temporary unavailability of one of the Goods.
3. In the case of partial shipment, the missing Goods do not halt the fulfillment of the remaining part of the order.
4. Refunds for unavailable Goods take place immediately, no later than within 14 days of informing the Customer.

VII. Prices and Payments

1. Prices are given in Polish zlotys (PLN) and include VAT.
2. In the event of a price reduction announcement, the Seller also informs about the lowest price of the Goods in effect during the 30-day period prior to the introduction of the reduction (in accordance with the Omnibus Directive).
3. If the Goods have been offered for less than 30 days – the lowest price since the start of sales until the introduction of the reduction is indicated.
4. Provisions regarding information on the lowest price do not apply to individual promotions or perishable products.
5. Available electronic payment methods and card payments are processed via Autopay S.A.
6. The Store enables payments by payment cards, in particular: Visa and Mastercard.

VIII. Withdrawal from the Agreement

1. The Consumer has the right to withdraw from the Agreement within 14 days without giving a reason.
2. The Consumer bears the direct cost of returning the Goods.
3. Exceptions to the right of withdrawal are specified in Art. 38 of the Consumer Rights Act.

IX. Complaints regarding Goods

1. The Seller is responsible for the conformity of the Goods with the Agreement in accordance with the Consumer Rights Act.
2. Complaints should be sent to the address:

3. The Seller will consider the complaint within 14 days.

XVI. Characteristics of Natural Products

1. The Goods sold in the form of dried and preserved plants are natural products.
2. Each specimen may differ in shade, shape, size, number of branches, structure, and color intensity.
3. Minor losses, color differences, natural discolorations, shedding of individual elements, and trace amounts of organic material are permissible.
4. The above features do not constitute a product defect or non-conformity of the Goods with the Agreement.

XIV. Final Provisions

1. In matters not regulated herein, the provisions of Polish law shall apply.
2. Disputes with Consumers are resolved according to the local jurisdiction resulting from the provisions of the Code of Civil Procedure.
